DUNCAN — Driving with a cracked windshield and a suspended driver’s license ended with two people in jail on numerous charges.
Amber Nicole McIntyre, 49, made her initial appearance Wednesday in Stephens County District Court where she received felony charges of aggravated fentanyl and methamphetamine trafficking, possession of firearms during the commission of a felony, acquiring proceeds from a drug activity and misdemeanor counts of driving with a suspended license and possession of drug paraphernalia, records indicate. The trafficking charges are punishable by between two years to life in prison and 85 percent of the sentence would have to be served before eligibility for parole.
Duncan Police Officer Kaleb Keplinger stated he saw a four-door Cadillac at a convenience store shortly after midnight Tuesday and noticed the cracked and spider webbed windshield. He knew the car was McIntyre’s and that she has a suspended license and learned from other investigators that Brenton Earl Johnson is her frequent passenger, the probable cause affidavit states. The officer stated Johnson has outstanding warrants from Jefferson County, Stephens County and an interstate compact warrant with the Oklahoma Department of Corrections.
When the car drove off, Keplinger followed and made the traffic stop. McIntyre got out of the car immediately and was ordered back inside, the affidavit states.
McIntyre and Johnson were taken into custody and she told the officer there were two guns by the driver’s seat and another in the rear of the vehicle, according to the affidavit. During the vehicle’s impound, burned foil used for smoking drugs was found behind the driver’s seat, Keplinger stated.
A search of the car turned up two pistols and an air soft pistol taped to look like a real gun. Inside a zipped pouch was found 10.8 grams of meth and under a factory compartment, officers discovered five Ziplock bags with 29.5 grams, 29 grams, 29.1 grams and 14.8 grams of meth, the affidavit states. Keplinger stated another bag contained 5.9 grams of a clear liquid substance mixed with fentanyl pills. Another pistol was discovered in a backpack in the vehicle’s back seat.
Police seized $106 from Johnson’s wallet and $572 from McIntyre’s purse, according to the affidavit.
Johnson, 55, of Arlington, Texas, received felony charges of aggravated fentanyl and methamphetamine trafficking, and acquiring proceeds from a drug activity and misdemeanor counts of driving with a suspended license and possession of drug paraphernalia, records indicate.
Johnson has prior felony convictions: Denton County, Texas, October 1995, engaging in organized criminal activity; Tarrant County, Texas – December 2006, unauthorized use of a motor vehicle; September 2011, unauthorized use of a motor vehicle; and December 2013, theft of property; and Hood County, Texas, theft of property, records indicate.
McIntyre is held on $150,000 bond and is scheduled to return to court at 9 a.m. May 29 for her preliminary hearing conference.
