A 67-year-old California man is in jail on $20,000 bond after he was charged with lewdly touching 10 and 16-year-old sisters.
Francisco Javier Montano, of Santa Maria, Calif., made his initial appearance Tuesday in Comanche County District Court where he received a felony charge of sexual battery, records indicate. The crime is punishable by up to 10 years in prison.
Elgin Police Officer Jason Barrier stated he was called to a domestic disturbance shortly before midnight Sept. 28 after, first, responding the report of a naked man walking in the road near the Elgin High School football field. He called for assistance to search for the naked man and went to the disturbance call. The man was not found.
A woman said she’d gotten into a physical fight with Montano after her 16-year-old daughter told her he’d touched the younger girl inappropriately, the probable cause affidavit states. The woman said she assaulted him and he’d left the home.
The 10-year-old girl said Montano had tried to get her into his room and when she wouldn’t, he touched her thigh before the older sister got her away from him, the affidavit states.
The officer looked in the room Montano had been staying in and found him asleep or passed out in the bed, wearing jeans and with a bloody nose, Barrier stated.
Montano told the officer he didn’t know what happened but denied doing anything wrong.
As part of his bond conditions, Montano is to have no contact with the girls. He returns to court at 3 p.m. Nov. 26 for his preliminary hearing conference.
