ANADARKO — After being declared competent, a Texas man’s rape charge was dismissed Wednesday before his preliminary hearing.
The Caddo County District Attorney’s office was granted a motion to dismiss a felony first-degree rape by force or fear charge against Avery Deangelo Wilkenes, 34, of Wichita Falls, Texas.
Following a preliminary hearing, Caddo County District Judge David A. Stephens dismissed the charge against Wilkenes without prejudice and without costs, meaning charges could later be refiled.
Wilkenes was arrested Feb. 8 after Apache police found him walking on a roadway. Police said he was lethargic, slurring words, having a difficult time standing up and seemed reluctant to talk. He asked for mental health help and spoke with a professional at Taliaferro Mental Health in Lawton, the warrant affidavit states.
A woman told Apache police Wilkenes, her friend’s boyfriend, had raped him. The woman had a SANE (sexual assault nurse examiner) kit collected, according to the affidavit.
Wilkenes was taken to the Caddo County Detention Center but was “very uncooperative,” according to police.
Following a competency examination, Wilkenes had been determined competent to resume criminal proceedings.
