A 17-year-old charged as an adult with sexually abusing two young brothers made his initial court appearance Wednesday.
Justin James Lodes, a.k.a. Justin Smallwood, of Lawton, appeared with his attorney, Mike Miller, in Comanche County District Court where he was charged with lewd or indecent acts to a child under 16, records indicate.
An arrest warrant was issued May 13 for Lodes.
Lawton Police Sgt. Marq Hackworth stated he was called to an elementary school on Feb. 26 and met with the school counselor who said an 11-year-old boy reported he and his 6-year-old brother were being sexually assaulted by Lodes. Department of Human Services was contacted and the boys were taken into custody with a family friend, the warrant affidavit states.
In the notice of his rights, Lodes was advised that at the conclusion of the State’s case during his preliminary hearing, he can offer evidence to support a motion for certification as a child.
Lodes’ preliminary hearing is scheduled for 1:30 p.m. Sept. 24 before Special District Judge Susan Zwaan. Bond was set at $50,000 with the order to have no contact with the boys.
