An Apache man accused of causing the death of Gilbert Leon Crow-Mihecoby in a hit-and-run wreck in September 2023 has been bound over for trial.
Following a preliminary hearing Wednesday, Comanche County Special District Judge Christine Galbraith found sufficient probable cause to bind Randy Allen Herring, 46, over for trial for felony counts of first-degree manslaughter, leaving the scene of a fatality accident and unauthorized use of a vehicle, records indicate.
Herring will appear before District Judge Jay Walker at 9 a.m. Aug. 26 for formal arraignment.
Crow-Mihecoby, 38, was killed in the wreck that happened around 3:30 a.m. Sept. 9, 2023, about two-fifths of a mile north of King Road on Northeast 120th Street, 1½ miles north of Fletcher. He was wearing a helmet, according to Trooper Ryan Hayes. Despite attempts at resuscitation, Crow-Mihecoby died at the scene.
Herring was driving a Dodge Ram pickup with his passenger, Jessica M. Dacus, 32, of Fletcher, and was leaving her home when Herring stopped in the middle of the roadway, according to a witness. Crow-Mihecoby was driving his motorcycle and ran into the back passenger quarter-panel of the truck, the affidavit states. Herring then drove back to the home.
After Crow-Mihecoby was pronounced dead, law enforcement looked for Herring but couldn’t find him or Dacus, even with the help of tracking dogs, according to the affidavit.
Later that day, the owner of the Dodge Ram spoke with investigators and said he’d let his daughter borrow the truck to move some personal property and that Herring and Dacus were with her the night before helping her move with Herring driving, the affidavit states.
A felony arrest warrant was issued for Herring on Feb. 22. He was taken into custody and had his initial court appearance on April 18. After posting $50,000 bond on May 8, he has been out of custody.
