DUNCAN A Duncan man jailed for allegations he broke his girlfriend’s rib is looking at up to life in prison for charges he tried to get her to not show up to court so his charges would be dropped.
Justin Leon Tollett, 48, made his initial appearance March 3 in Stephens County District Court where he received a felony charge of domestic assault and battery resulting in great bodily harm after two or more felony convictions and a misdemeanor count of malicious injury to property, records indicate. He has been held on $15,000 bond since his initial court appearance.
On Friday, Tollett received three charges of witness intimiation.
The domestic assault charge stems from a Sept. 24, 2024, incident at Tollett and his girlfriend’s apartment at 3625 N. U.S. 81. Police found the woman with blood all over her shirt and wounds to her arm, the probable cause affidavit states. She said he’d come home drunk and got physical with her and he’d kicked in a door to get to her, Duncan Police Officer Kirsten Thomas stated. He was arrested for the assault as well as a first-degree burglary charge that was dismissed on Feb. 10 and refiled on Feb. 28 as a felony.
Police learned that three days later, the woman went to the hospital where she was diagnosed with a broken rib and internal injury, the affidavit states.
Tollett was jailed on Feb. 27 awaiting his initial appearance. Investigators learned he’d made several calls to the woman where he told her not to show up at court so his case would be dismissed, Stephens County Sheriff’s Sgt. Kyle Wheeler stated. There were three different calls recorded with similar instructions, according to the affidavit.
Tollett has prior felony convictions from January 1995 for distribution of controlled dangerous drugs in Okfuskee County, and from September 2003 for uttering forged instruments in Cleveland County, records indicate.
Another $50,000 bond was issued for Tollett for the latest charges.
