A Comanche County jury acquitted a Lawton man for an allegation of assault with a dangerous weapon.
On Tuesday, following about an hour’s deliberation, the jury found Jared Kristen Harvey, 48, not guilty of a felony count of assault with a dangerous weapon after former felony convictions, records indicate.
Harvey was accused of assaulting a Door Dash delivery driver dropping off an order at 704 NW 35th Place in May 2023. The driver told police he’d put food down on the porch and went to take a photo to send to the person who ordered it, he said he was struck in the back of the head with some sort of blunt object.
While running away, he said, he tripped in the yard and struck a brick mailbox, causing a 5- to 6-inch gash to the right side of his head, the affidavit states. The driver was messaged by the person who ordered the food to apologize for the incident and named Harvey as the suspect.
Harvey told police he’d been inside the garage when he heard a noise from the front porch and went to investigate. He said he believed someone was trying to break in so he “used his stick that he carries” to hit the man, according to the affidavit. Harvey provided police with a roughly 3- to 4-foot branch as the weapon before being taken into custody.
Harvey had been held on $50,000 bond following his initial appearance May 16, 2023.
