Lawton man accused of using grandma’s gun in shooting

A Lawton man is accused of taking his grandmother’s gun and later shooting a man with it.

Emmanuel Victor Rosa Jr., 26, made his initial appearance Tuesday in Comanche County District Court where he received felony charges of assault and battery with a dangerous weapon after four former felony convictions and possession of a firearm after former felony convictions, records indicate.

Rosa is accused of shooting a man in the stomach Oct. 24 at 210 SW Summit. The victim told Lawton police Rosa shot at him two or three times before hitting him, the probable cause affidavit states. He said after one bullet struck, Rosa fired another shot at him while he was lying on the ground. He said he felt it pass through his hair, according to police. He identified Rosa as the shooter.

Detective Michael Boudreaux spoke with the homeowner who said her son lives in her garage. She said she saw him, his girlfriend and Rosa in the garage with little packets as well as a pistol on the table, the affidavit states. She was unsure what was in the packets.

The woman said she heard Rosa say, “I’m going to get him, he took my medicine,” Boudreaux stated. Moments later, she went to the front yard to smoke a cigarette and heard three gunshots come from the backyard, according to the affidavit. She said Rosa was standing near the gate of the victim’s backyard with a gun in his hand and that she saw him fire it one more time into the man’s backyard before fleeing.

Rosa’s grandmother told police she’d let Rosa come inside her house two days before to take a shower because “she felt sorry for him,” the affidavit states. She said he went through her drawers and found her .22 caliber revolver before leaving, according to Boudreaux. Rosa was arrested on Oct. 27.

Rosa has prior felony convictions in Comanche County from April 2021 for three counts of second-degree burglary and one for larceny of an automobile, records indicate.

Held on $100,000 bond, Rosa returns to court at 3 p.m. Feb. 27, 2024, for his preliminary hearing conference.
