The Oklahoma State Supreme Court ruled today that two abortion laws passed in 2022 are unconstitutional.
House Bill 4327 and Senate Bill 1503 were signed into law by Gov. Kevin Stitt after winning approval from the House and Senate in 2022. SB 1503 prohibits abortion after detection of a fetal heartbeat, except in cases of medical emergency, while HB 4327 is a total ban on abortion unless it is necessary to save the life of the mother or the pregnancy is the result of rape, sexual assault or incest that has been reported to law enforcement.
Wednesday’s court ruling said that banning abortion in most cases conflicts with a March decision in Oklahoma Call for Reproductive Justice v. Drummond, where the court found the state constitution protects the right to abortion in life-threatening situations.
