A Comanche County jury took around an hour to convict a 24-year-old Geronimo man for a 2023 murder case.
When read the decision, witnesses said, he caused an outburst in Comanche County District Judge Jay Walker’s courtroom before he was subdued by around 10 deputies.
Timothy David Carpenter was found guilty of first-degree murder – deliberate intent and possession of a firearm after former felony convictions. The jury recommended he serve life in prison without parole for the murder count and an additional 10 years for the gun count.
Carpenter was found culpable of shooting and killing Anthony Montoya the morning of Oct. 6, 2023. Montoya was found dead from a gunshot wound in front of the office building of an apartment complex at 2235 NW Hoover, according to the probable cause affidavit.
Witnesses testified Montoya had gone to the Apache Casino with them before the incident but he’d left without telling them where he was going. He called them around 3:30 a.m. asking them to pick him up at the apartments. Testimony included statements that Carpenter refused to ride with Montoya. An argument between them ended with a single gunshot from Carpenter, the jury decided.
Carpenter has a May 2022 felony conviction in Comanche County for larceny of an auto/aircraft/other motor vehicle, according to Oklahoma Department of Corrections records.
Denied a pre-sentence investigation, Carpenter will be formally sentenced at 4 p.m. Friday.
